TO: All CEPU Members in Post
(17 December, 2009): The CEPU has been ordered by Fair Work Australia Commissioner Foggo to issue this Circular.
The CEPU, its delegates, officers, employees, agents and members must:
(a) stop, not organise and not engage in stoppages of work (“Stoppages”) on 17, 18 and 21 December – as previously advised to Post on 11, 14 and 15 December
(b) not organise, aid, abet, direct, produce, induce, authorise, incite, advise, persuade or encourage any of the employees to:
(i) refuse or fail to attend for work as directed;
(ii) refuse or fail to perform any work at all; or
(iii) otherwise engage in the industrial action; being Stoppages on 17, 18 and 21 December
(c) not threaten or propose to do any of the things referred to above, on 17, 18 and 21 December
(d) not maintain any organisation of the Stoppages, on 17, 18 and 21 December
(e) not maintain any incitement, advice, persuasion or encouragement of the type referred to above.
The effect of this order from FWA is that the Stoppages planned for 17, 18 and 21 December are cancelled and CEPU members must not engaged in any stoppages of work on 17, 18, and 21 December.
